Chapter One: Introduction

1.1 Background of the Study
Women's access to land remains a significant challenge in many parts of Nigeria, including Kano Municipal LGA, where traditional and legal barriers restrict women’s ability to own or inherit land (Sulaimon & Abubakar, 2023). The Nigerian Constitution guarantees gender equality and the right to own property, but cultural practices and discriminatory laws often limit women’s access to land, which is crucial for economic empowerment. This study will evaluate how constitutional law influences women's access to land in Kano Municipal LGA, examining both legal provisions and the socio-cultural factors that affect land ownership for women.

1.2 Statement of the Problem
Despite constitutional guarantees of gender equality, women in Kano Municipal LGA face significant barriers in accessing land, primarily due to patriarchal societal norms and traditional inheritance systems that favor men. This study will explore how the constitutional framework addresses these issues and the challenges women face in asserting their land rights in the face of cultural opposition.

1.3 Objectives of the Study

  • To assess the impact of constitutional law on women’s access to land in Kano Municipal LGA.

  • To identify the legal and cultural barriers women face in securing land rights.

  • To propose legal reforms aimed at improving women’s access to land in Kano Municipal LGA.

1.4 Research Questions

  • How effective are constitutional provisions in ensuring women’s access to land in Kano Municipal LGA?

  • What legal and cultural barriers hinder women’s access to land in the area?

  • What reforms can be introduced to enhance women’s access to land in Kano Municipal LGA?

1.5 Research Hypothesis

  • H₁: Constitutional law has not significantly improved women’s access to land in Kano Municipal LGA due to weak enforcement and cultural barriers.

  • H₂: Cultural practices and traditional inheritance systems are major obstacles to women’s land ownership in Kano Municipal LGA.

  • H₃: Strengthening legal provisions and enforcing gender equality laws will significantly improve women’s access to land in Kano Municipal LGA.

1.6 Significance of the Study
This study will shed light on the challenges women face in accessing land, despite constitutional provisions for gender equality. It will provide recommendations for legal reforms and policy interventions that can help secure women’s land rights, ultimately contributing to gender equality and economic empowerment.

1.7 Scope and Limitations of the Study
The study will focus on Kano Municipal LGA, Kano State, and will assess the relationship between constitutional law and women’s land rights. Limitations include challenges in overcoming cultural resistance and difficulties in obtaining data on land ownership practices.

1.8 Operational Definition of Terms

  • Land Ownership: The legal right to possess, use, and transfer land.

  • Constitutional Law: The body of laws derived from the Nigerian Constitution, particularly those guaranteeing gender equality and property rights.

  • Gender Equality: The state of having equal rights, opportunities, and treatment for both genders.
